‘New Waqf Act To Cut Muslim Members On Central
Nagpur: The Waqf Amendment Bill, now referred to a joint parliamentary committee, proposes to outnumber Muslims on the Central Waqf Council (CWC) as well as the 35 state Waqf boards, both of which currently have members only from the Muslim community.
This was one of the several points raised during a symposium by retired CEO of Maharashtra State Waqf Board Shaikh Abdul Rauf on Saturday.
Making a PowerPoint presentation before a group of intellectuals, Shaikh said the current composition of CWC has all 14 Muslim members but has now been replaced by a new provision of 22 members where the count of Muslims would drop to 10. Similarly, he said only three Muslims have been allowed on the state boards. Rauf said the bill, if passed and becomes an Act, is set to open several conflicts and spell doom for the community.He also answered several questions regarding the Waqf.
Titled ‘Waqf Amendment Bill 2024 Advantages and Dangers’, Rauf said the hidden dangers of the new bill are shrouded in five clauses. “These include increasing the CWC size to 21 members, plus a chairperson, from the present 14. It will have only 10 Muslims, while the rest can be from the general category or non-Muslims. The CWC will also have two women while non-Muslims can be a minimum of 2 and a maximum of 12,” he said.
“The state Waqf boards can now have a non-Muslim as its CEO. The board will be nominated by the govt, while the chairman, MP, and MLA can be from the general category. The number of Muslims on each board is restricted to three only mutawalli, religious scholar, and local body members two or more. Thus the board can be of majority non-Muslims presiding over the religious affairs of Muslims,” he said.
Registration of old institutions has been made quite difficult as no Waqf can be created without executing a Waqf deed, he said. “Several properties are centuries old and haven’t yet registered. Sec 40 is omitted, so no new properties can be investigated and declared as Waqf. Omission of ‘Waqf by user’ means old unregistered masjids, dargahs cannot be registered,” he said.
